Please read this Agreement carefully before you start using our Services. This agreement tells you who we are, how we provide our service to you, how this Agreement may change or be changed. FTFT FINANCE UK LIMITED TERMS AND CONDITIONS
DEFINITIONS:
“Agreement” means these terms and conditions together with the Privacy Policy published below in this document.
“Platform” means the FTFT FINANCE UK mobile and web applications, and all communication made to and from FTFTFINANCE UK customer service representatives, including but not limited to communication via phone call, email, SMS, WhatsApp and push notification.
“We”, “Us”, “Our” refers to “FTFT FINANCE UK”
“You” or “Your” refers to the User.
“User” means e-money account customers who use the Platform.
“Agreement” means these terms and conditions together with the Privacy Policy published below in this document.
“Platform” means the FTFT FINANCE UK mobile and web applications, and all communication made to and from FTFTFINANCE UK customer service representatives, including but not limited to communication via phone call, email, SMS, WhatsApp and push notification.
“We”, “Us”, “Our” refers to “FTFT FINANCE UK”
“You” or “Your” refers to the User.
“User” means e-money account customers who use the Platform.
- Information on FTFT Finance UK and the Agreement
- FTFT FINANCE UK LIMITED is a wholly owned subsidiary of Future Fintech Group Inc. (NASDAQ: FTFT). We are an SEC and FCA dual-supervised cross-border money transfer systems and service provider.
Future Fintech Group Inc. is a corporation that specialises in providing global financial services and financial-technology (“FinTech”), with locations and operations based in New York, London, Dubai, Hong Kong, Beijing, Asunción, and many more. - FTFT FINANCE UK LIMITED registered and incorporated under the laws of the United Kingdom with company registration number 06832517, and registered office address at Wework Building, 10 York Road, London, England, SE1 7N.
- This Agreement sets out the terms and conditions that apply to the provision of FTFT Finance UK’s services, in particular the remittance services (the “Services) that enable You to transfer money through FTFT Finance UK to the country of your liking. By using the Services, You agree to the terms and conditions of this Agreement.
- FTFT Finance UK Limited LTD is a regulated payment institution, regulated by the FCA (Financial Conduct Authority) with FCA Registration Number 584039.
- This Agreement should be read in conjunction with FTFT Finance UK’s Privacy Policy which sets out further terms and conditions in relation to the provision of the Services. Find Our Privacy Policy published below in this document.
- We reserve the right to refuse Your application for an account at our sole discretion including if we suspect that you are involved in or are intending to use the account to be involved in, money laundering, terrorist financing, fraud or other illegal activity. We will inform you if your registration is refused, but we are not obligated to disclose the reasons for the refusal.
- FTFT FINANCE UK LIMITED is a wholly owned subsidiary of Future Fintech Group Inc. (NASDAQ: FTFT). We are an SEC and FCA dual-supervised cross-border money transfer systems and service provider.
- Registration
- To apply for Our Services, You must register Your details on Our Platform. You will be required to provide Us with information such as Your full name, email address, date of birth, full address and mobile phone number.
- When You register, You will be asked to create a secure password. You are solely responsible for maintaining the confidentiality of Your FTFT Finance UK account login and password, and You accept responsibility for all activity that occurs under Your FTFT Finance UK account. If You believe that Your account is no longer secure, then You must immediately notify Us and Our designated Data Protection Officer at: dpo@uk.ftft.com.
- You agree that You will not: I. create an account for anyone but Yourself;
II. create an account with the intent of impersonating another individual; or
III. create an account that is subject to any third-party rights without appropriate authorisation. We reserve the right to refuse the registration of an account or to cancel an account at any time. - Eligibility
- Your use of Our remittance Services will only be approved if We deem that You are eligible to access Our Services. This means that You must be at least 18 years old, and You must provide us with all requested information to assess Your eligibility. We reserve the right to refuse the right to terminate or suspend Your access to Our Services for such any reason.
- Before We approve Your Transaction, We will require documentary proof of identification in the form of a valid and current ID card, driver’s licence, or passport to verify Your identity. We may also carry out electronic checks on You, where Your personal information may be disclosed to credit reference agencies and fraud prevention agencies. These agencies may keep a record of the information and a footprint may be left on Your credit file, although the footprint will denote that the search was not a credit check and was not carried out in support of a credit application. It is an identity check only and will therefore have no adverse effect on Your credit rating. Your access to and use of FTFT Finance UK Services and Platform will indicate Your consent to these checks.
- Use of the Services
- Subject to Your compliance with this Agreement, FTFT Finance UK grants You, solely for Your personal use, a limited, non-exclusive, non-assignable, non-transferable, non-sublicensable, and revocable licence to access and use the Services via the Platform for lawful purposes. You shall not sell, license, rent, or otherwise use, exploit, or make available any Services content, in whole or in part, for commercial (whether for or not for profit) use or in any way that infringes any third-party rights.
- We will use the personal information that You provide to grant You the Services and where You have provided applicable consent, for marketing purposes. If You no longer wish to receive marketing materials from Us, You can let Us know by updating Your account preferences.
- You agree that FTFT Finance UK may use Your feedback, suggestions, or ideas (“Feedback”) in any way, including in future modifications of the Services, other products or Services, advertising or marketing materials. You grant to FTFT Finance UK a perpetual, worldwide, fully transferable, sublicensable, irrevocable, fully paid-up, royalty-free licence to use the Feedback You provide to Us in any way. Your Feedback will never be published in an identifiable format. We will only share Your feedback with Our Banking Partners in an aggregated format where no individual is identifiable and use it in a way that is fully compliant with the GDPR and all relevant data protection laws and policies as they may apply.
- Once you place a Transaction via our Website or app, an email will be sent to you acknowledging that your transaction has been created. Please note that upon creating a successful transaction it does not mean that your or transaction is accepted as compliance would have to check the transaction.
- We shall not be liable for any damages, costs, losses incurred by the sender when a transaction has been placed.
- Information provided by FTFT FINANCE UK before a transaction is placed
- The amount the recipient will receive.
- Total Fees you will be charged.
- Location and destination where the recipient will collect the money.
- Estimate of time the funds will take for the recipient to be able to collect.
- If the transaction is not complete and paid for all information in the order will remain valid for 24 hours. If we have not received the relevant funds from you within this time frame, the order will be cancelled.
- Information provided by FTFT FINANCE UK after a transaction is placed
After you successfully paid for your transaction and we have processed it, you will receive an email with the following information:- The transaction Pin Number
- Confirmation of your sending amount and the amount your recipient will receive.
- The exchange rate applied.
- Location for collection of the funds in case of cash collection
- An estimated timeframe of when the money will be available to the recipient.
- Cancellations and refunds
- The You have the right to cancel a transaction before we pay out the receiver. You must email us at supprt@uk.ftft.com
- If you cancel the transaction after we have received the funds we will:
- The funds paid to us will be only refunded if we have not paid out the recipient.
- We have the right to retain fees and charges for the services we provide.
- If you notify us of the cancellation for which we have already sent the money to the pay out location then the cancellation of this refund is dependent on the time and length of period our partner takes to respond to us. - If refund is processed it may take up to 5-10 working days for refunds to be credited into your account.
- We reserve the right not to refund amounts smaller than £20.00 if the refund has been requested by the customer with no fault of our own.
- We will cancel any payment that is intended to be paid out into the account of a commercial account including but not limited to, charities, business accounts.
- In the event if incorrect details have been provided by you and you have not exercised the rights to cancel the transaction (in case of bank deposit) your transaction will be automatically cancelled in 7 Days.
- Term
This Agreement is indefinite and will continue until termination of the Agreement, pursuant to clause - Termination
- This agreement can be terminated by You by giving prior written notice via the Platform or an email to support@uk.ftft.com
- This Agreement can be terminated with immediate effect by Us where:
- You breach an important part of this Agreement, or repeatedly breach this Agreement and fail to resolve the matter with 10 days;
- You use Your account in a manner in which We reasonably believe is fraudulent or unlawful;
- You fail to pay fees or charges that You have incurred.
- This Agreement can be terminated by Us for no or any reason, by giving prior written notice. Your funds will be returned to You via bank transfer.
- Upon termination of these Terms, You will no longer be authorised to access Your account and Your funds will be returned back to You via bank transfer
- Intellectual Property
The Services and Platform and intellectual property rights in the Services and Platform are owned (or licensed) and operated by FTFT FINANCE UK. All visual interfaces, graphics, design, photos, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Services (“Materials”) provided by FTFT FINANCE UK are protected by intellectual property and other laws. All Materials included in the Services and Platform are the property of FTFT FINANCE UK or its third-party licensors. FTFT FINANCE UK and Our third-party licensors reserve all rights in any intellectual property in the Materials. - Confidentiality
You are responsible for keeping Your account details safe. You must take all reasonable steps to avoid the loss, theft, or misuses of the e-current account details. Failure to comply with this may be treated as gross negligence and may affect Your ability to claim any losses. - Limitation of liability
- We accept no responsibility for any loss that arises in connection with the theft of Your account details or password by any unauthorised third parties, unless such losses arise after You have notified Us that Your account has been compromised.
- We shall not be liable to You for any losses You suffer or costs You incur as a result of:
- You being unable to access or use the Services;
- any device including any hardware or software You use to access the Services being damaged, corrupted or failing to work;
- the Services containing errors, defects, or not meeting Your requirements;
- You not receiving notifications from Us or Our Banking Partners in a timely manner; or
- You granting third-party access to the Services. - We will not be liable for any fault or failure relating to the use of the account provided by FTFT FINANCE UK that is a result of abnormal and unforeseeable circumstances beyond Our control which would have been unavoidable despite all Our efforts to the contrary, including but not limited to, a fault in or failure of data processing systems; nor any loss of profits, loss of business, or any indirect, consequential, special or punitive losses arising from Your use or Your inability to use the account.
- We would not be liable for any losses incurred by your transaction in case of delay or cancellations.
- We do not bear any liability for you providing any incorrect details about your Recipient, including – but not limited to – errors and typos. If a Transaction has been picked up by another person than the Recipient, because of your failure to provide correct details, we will only be obliged to provide reasonable assistance to try to retrieve the funds back and if we are unable to retrieve the funds we are not liable for the losses. We may charge you for any such assistance.
- We bear no liability if the wrong receiver collects the money as you are the only individual that has the transaction pin number and give it to your recipient or if it is bank transfer you are responsible for inputting the correct bank account details.
- Notifications and marketing communication
If We need to contact You or send You a notification under this Agreement, We will do so by sending an email to the email address or phone number which You provided Us when You registered with Us. For further information, see our Privacy Policy. - Data Protection
We collect certain information about the Users of Our Services in order to operate Our Services. FTFT FINANCE UK are Data Controllers of Your personal data and will manage and protect Your personal data in accordance with our Privacy Policy. - Miscellaneous
- Changes to this Agreement will be publicised on Our Platform.
- Notices must be in writing via email.
- This document, along with the Privacy Policy incorporated into this Agreement, shall constitute the entire agreement.
- This Agreement shall be governed by the law of England and Wales. All disputes arising out of or relating to this Agreement shall be subject to the jurisdiction of the courts of England and Wales.
- We may assign the benefit and burden of this Agreement to another entity at any time. You will be deemed to accept the assignment if You do not respond, and You continue to use Your account. If You do not accept the assignment, then You may end this Agreement in accordance with clause 8. You may not assign the benefit or burden of this Agreement to any third party at any time.
- If any term or provision in this Agreement shall be held to be illegal or unenforceable, in whole or in part, under any enactment or rule of law, such term or provision or part shall to that extent be deemed not to form part of this Agreement but the validity and enforceability of the remainder of this Agreement shall not be affected.
- Complaint and Contacting Us
- If you wish to contact us for any reason, including because you have any complaints, you can contact us by emailing us at support@uk.ftft.com. We can also be contacted in-app via our help function.
- If we have to contact you or give you notice in writing, we will do so by email, through the site or App or through an instant messaging service using details you provide to us. We may also contact you by telephone or SMS.
- It is your responsibility to ensure the contact information we have for you is up to date. You are required to notify us promptly if there is a change to: your name; your address; your Personal Accounts; your mobile number and/or your status as a UK resident. Following any of these changes It might be necessary for us to ask you for, and for you to provide, more information as part of this process.
- We may record and monitor telephone conversations that we have with you. We will store recordings in accordance with applicable law, and / or for as long as we consider necessary to be able to provide the Services to you.
- Security Incidents
- If we become aware or suspect that you are affected by fraud or an operational security incident, some, or all of the functionality of your account may be limited until such time that the suspected incident is resolved.
- If you believe that your account has been compromised or do not recognise activity on your account, contact us via the means in clause 15.
